Plaintiff-Appellant State of Hawaii (the prosecution) appeals from the August 16, 2000 order of the first circuit court (the court) granting the motion to suppress statement filed by Defendant-Appellee Nathaniel Penn (Defendant). On appeal the prosecution contends that the motion was improperly granted, inasmuch as Defendant waived his right to counsel during his interrogation by Honolulu Police Department Detective Robert Cravahlo. Defendant, however, appeared to be under the misconception that he would have to schedule an appointment with an attorney prior to being able to receive free legal services; this and other circumstances support the courts order.
